These Terms of Use (“Terms”) govern your access to and use of the Guardian Legacy website (the “Site”), operated by Guardian Legacy (Pty) Ltd (“we,” “us,” or “our”), a South African company specialising in life settlements. By using this Site, you agree to be bound by these Terms. If you disagree, you must discontinue use immediately.

By accessing the Site, you confirm that you are at least 18 years old and legally capable of entering into binding agreements under South African law. These Terms incorporate our Privacy Policy, Data Protection Policy, and Disclaimers.

The Site provides information about life settlements and enables financial advisors to upload policy documents for processing. We facilitate connections between policyholders, advisors, and buyers but do not guarantee specific outcomes. All transactions are subject to applicable South African laws, including the Financial Advisory and Intermediary Services Act (FAIS).
 

3. User Accounts and Uploads

  • Registration is required to upload documents. You must provide accurate information.

  • You are responsible for keeping login credentials secure.

  • Documents must comply with the Protection of Personal Information Act (POPIA). You warrant that you have obtained all necessary consents from data subjects (e.g., policy owners).

  • We reserve the right to review, reject, or remove uploads that breach laws or these Terms.
     

4. Intellectual Property

All content on the Site, including text, graphics, and logos, is owned by us or our licensors. You may not copy, distribute, or modify content without prior written consent, except for personal, non-commercial use directly related to life settlements.


5. Acceptable Use

You may use the Site only for lawful purposes. Prohibited activities include:

  • Uploading false, misleading, or unauthorised personal information.

  • Violating data protection or intellectual property laws.

  • Fraudulent, abusive, or disruptive conduct that may compromise the Site.


6. Limitations and Disclaimers

The Site and its services are provided “as is.” We make no warranties regarding accuracy, reliability, or outcomes. We are not liable for damages arising from Site use, data breaches (subject to POPIA obligations), or failed transactions. See our separate Disclaimers for more detail.


7. Termination

We may suspend or terminate access at our discretion if you violate these Terms. Upon termination, you must stop using the Site and delete any downloaded materials.


8. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will fall within the jurisdiction of the courts of Johannesburg.


9. Changes to Terms

We may update these Terms at any time. Continued use of the Site after changes are published constitutes acceptance.

Privacy Policy

  • Assess and facilitate life settlement transactions.

  • Comply with statutory requirements (e.g., FAIS, FICA).

  • Maintain Site security and administration.

  • Send marketing communications (only with consent and opt-out options).


3. Legal Basis for Processing

  • Consent (e.g., uploads by advisors).

  • Contract performance (e.g., facilitating transactions).

  • Legal compliance.

  • Legitimate interests (fraud prevention, business operations).


4. Disclosure of Information

We may share information with:

  • Service providers (e.g., secure storage providers).

  • Regulators (e.g., FSCA).

  • Buyers in settlement transactions (with safeguards).
    International transfers occur only under POPIA Section 72 safeguards.


5. Your Rights under POPIA

You may:

  • Request corrections or deletion.

  • Object to processing (e.g., for marketing).

  • Withdraw consent (note: this may affect service delivery).

  • Be notified of data breaches.


6. Security Measures

We use encryption, access controls, and regular audits. Breaches are reported in line with POPIA Section 22.


7. Retention

Data is retained as legally required (e.g., FICA: 5 years) and deleted securely thereafter.


8. Children’s Information

We do not knowingly process information of persons under 18.


9. Changes to this Policy

We may amend this Policy from time to time. Updates will be posted on this Site.
